Welcome to AGoodTrip.com (the "Website" or "Site"), operated by AGoodTrip ("AGoodTrip," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site, such as booking travel services (e.g., tours, excursions, hotels, cruises, and transportation). By accessing, browsing, or using the Site, or by making a reservation through us, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or our services.
AGoodTrip acts solely as a booking agent and affiliate for third-party suppliers ("Suppliers"), including tour operators, cruise lines, hotels, airlines, ground transportation providers, and other independent contractors. We are not the source or provider of travel services; we facilitate bookings on behalf of these Suppliers. Separate terms and conditions from Suppliers will apply to your reservations, and by booking through us, you agree to comply with those terms. We earn commissions from affiliates for successful bookings.
1. Acceptance of Terms: By using the Site or booking services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy [https://agoodtrip.com/privacy-policy], which is incorporated herein. These Terms constitute a legally binding agreement between you and AGoodTrip. We reserve the right to modify these Terms at any time by posting the updated version on the Site. Your continued use after such changes constitutes acceptance. It is your responsibility to review these Terms periodically.
2. Eligibility and Account Responsibility: You must be at least 18 years old and have the legal capacity to enter into these Terms and make bookings for yourself or your party. You agree to provide accurate, current, and complete information during registration or booking and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account, including those by minors or others you authorize. Unauthorized use, including speculative, false, or fraudulent bookings, is prohibited and may result in account termination.
3. Use of the Site
- **Permitted Use**: You may use the Site for personal, non-commercial purposes to research and book travel services.
- **Prohibited Conduct**: You may not use the Site to: (a) violate laws or rights of others; (b) upload viruses or malicious code; (c) attempt to gain unauthorized access; (d) scrape or copy content without permission; or (e) engage in any activity that disrupts or interferes with the Site’s operation.
- **Content Ownership**: All content on the Site (text, images, logos, etc.) is owned by AGoodTrip or licensed to us and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without written consent, except as permitted for personal use.
4. Booking and Payment Terms
- **Booking Process**: All bookings are subject to availability and confirmation by the Supplier. We act as an intermediary and are not responsible for Supplier performance. A confirmation email with booking details and Supplier terms will be sent upon reservation.
- **Payment**: Full payment or a deposit (as required by the Supplier) is due at booking. We accept major credit cards and process payments securely. You are responsible for any bank or card issuer fees. Prices are quoted in USD unless otherwise noted and may include taxes and fees, though additional Supplier charges (e.g., port fees, gratuities) may apply.
- **Changes and Cancellations**: Requests must be submitted in writing via email [help@agoodtrip.com] or through your account. An administrative fee per person, plus Supplier cancellation penalties, may apply. Some bookings are non-refundable, and no refunds are issued for unused services.
- **Price Changes**: Prices are subject to change due to currency fluctuations, fuel surcharges, or Supplier adjustments. We will notify you of significant changes before confirmation, but confirmed bookings are generally non-amendable unless allowed by the Supplier.
- **Group Bookings**: For groups of 10 or more, special terms may apply, including non-refundable deposits and extended cancellation policies.
Gratuities and additional fees: Wherever possible, the travel agent will attempt to inform the client of any additional costs such as hotel taxes payable upon check in or resort fees. Hotel taxes may appear on travel vouchers at time of confirmation, and are not always able to be shown during the initial quote. The travel agent is not responsible for any omissions of additional fees during the quote process. These types of fees include:
Gratuities to guides, hotel staff, or drivers
Mandatory onboard service charges/gratuities for cruises
City taxes payable directly at the hotel (very common in Europe)
Costs for transport to/from the airport if traveler did not include transfers in quote
Breakfasts or other meals at hotels unless they are specifically included in quote
Travel agent is not responsible for any increases due to fuel surcharges, government imposed taxes/fees or supplier-imposed increases.
Chargeback Policy: A Good Trip considers credit card chargebacks to be fraud if you made no reasonable effort to notify us that a problem existed, or to resolve or clarify a situation or matter. You agree that you will not chargeback any amounts charged to your credit card by A Good Trip or its vendors and/or suppliers If you chargeback a credit card charge for a payment initiated by you, you agree that we may recover the amount of the chargeback, as well as the chargeback fee of $150 by any means we deem necessary.
5. Travel Documents and Requirements: You are solely responsible for obtaining and carrying valid travel documents, including passports (valid for at least six months beyond your return date), visas, health certificates, and proof of vaccinations or COVID-19 testing as required by destinations. Check government resources (e.g., U.S. State Department at travel.state.gov, CDC at cdc.gov/travel) and enroll in the Smart Traveler Enrollment Program (STEP) for alerts. Names on documents must match booking details exactly. Some countries require a visa for transit or entry. Passengers are responsible to ensure that they have all the proper documents for entry. All names on documents must match the legal name on your photo I.D., and travel document information must match tickets. If you are a citizen of another country, there may be additional requirements. Check with the nearest consulate or embassy of the destination you are traveling to and find out the entry requirements for non-U.S. citizens. Failure to comply may result in denied boarding or entry, and we are not liable for associated costs (e.g., missed cruises, rebooking fees). Children under 18 may require parental consent or additional documentation. Travel insurance is strongly recommended to cover such risks.
6. Health, Safety, and Assumption of Risk: Travel involves inherent risks, including illness, injury, natural disasters, political unrest, and acts of terrorism. We recommend travel insurance covering medical emergencies, trip cancellation, interruption, and evacuation. Review CDC and State Department advisories before travel.
You acknowledge risks associated with booked activities (e.g., hiking, water sports, wildlife tours) and agree to follow all safety instructions from Suppliers. We do not provide medical advice; consult your healthcare provider for vaccinations or health concerns. Consumption of alcohol or drugs during activities is at your own risk, and we disclaim liability for resulting injuries or damages. We are not liable for health-related issues arising from non-disclosure of pre-existing conditions.
7. Liability and Disclaimers
- **Supplier Liability**: We are not liable for the acts, omissions, delays, cancellations, or quality of services provided by Suppliers, who are independent contractors. Any warranties or guarantees are those of the Supplier, passed through to you.
- **Force Majeure**: We are not responsible for failures or delays due to events beyond our control, including weather, natural disasters, strikes, government actions, pandemics, or terrorism.
- **Website Content**: Information on the Site is provided for convenience and may contain inaccuracies. We disclaim liability for decisions based on this content. Verify details with Suppliers or official sources.
- **Limitation of Liability**: We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- **Indemnification**: You agree to indemnify, defend, and hold harmless AGoodTrip, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Site, breach of these Terms, or violation of any law.
8. Privacy Policy: We collect personal information (e.g., name, contact details, payment info) to process bookings and improve services. This data may be shared with Suppliers, affiliates, or third-party service providers for fulfillment purposes. 9. Affiliate Disclosures: AGoodTrip participates in affiliate programs with Suppliers like Viator, Shore Excursions Group, GetYourGuide, and others. When you click affiliate links and complete bookings, we earn commissions. This does not affect the price you pay, and we disclose this per FTC guidelines for transparency. Affiliate earnings support the Site’s operation but do not influence our recommendations.
10. Intellectual Property: The Site and its content are owned by AGoodTrip or licensed to us and protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works without written permission, except for personal, non-commercial use (e.g., printing a confirmation). Supplier content is protected by their intellectual property rights.
11. Governing Law and Dispute Resolution: These Terms are governed by the laws of California, USA, excluding its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in California, Santa Clara county. You consent to the jurisdiction of these courts and waive any right to a jury trial or class action. Arbitration may be available at our discretion under AAA rules, with costs split unless otherwise ordered.
12. Termination and Suspension: We may suspend or terminate your access to the Site or services at any time, with or without cause or notice, including for breach of these Terms. Upon termination, you lose access to bookings or account data, and no refunds are owed unless required by law or Supplier policy.
13. Special Offers and Promotions: Special offers are subject to availability and may have additional terms (e.g., blackout dates, minimum stays). Discounts or promotions cannot be combined unless specified. We reserve the right to withdraw offers at any time.
14. Compliance with Laws: You agree to comply with all applicable local, state, federal, and international laws, including export controls and travel restrictions. We are not responsible for your failure to comply, which may result in fines, detention, or denied entry.
